General Terms
Applies to all services
These general provisions govern your relationship with HOMB CLOUD FZ-LLC across all services. Each service also has its own specific terms set out in Parts A, B, and C below.
01 About these terms
These Terms and Conditions ("Terms") govern your access to and use of the services provided by HOMB CLOUD FZ-LLC ("Homb Cloud", "we", "us", or "our"), a company registered under the laws of the United Arab Emirates Free Zone.
By accessing our platform or purchasing any service, you ("the Client", "you") confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use our services.
02 Definitions
- "Platform" means the Homb Cloud website and associated digital infrastructure at hombcloud.com.
- "Services" means cloud mining, mining hosting, and the miner marketplace, individually or collectively.
- "Order Confirmation" means the written confirmation issued by Homb Cloud upon acceptance of a purchase.
- "Equipment" means any mining hardware owned by or on behalf of the Client and hosted at a Homb Cloud facility.
- "Hashrate" means the computational power allocated to a Client under a Cloud Mining contract.
- "Supplier" means a third-party hardware manufacturer or authorised distributor listed on the Marketplace.
- "Seller" means a third-party individual or entity listing second-hand hardware on the Marketplace.
03 Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract in your jurisdiction to use our Services. By using the Platform, you represent and warrant that you meet these requirements.
Use of our Services may be restricted or prohibited in certain jurisdictions. It is your sole responsibility to ensure compliance with the laws applicable in your location before placing any order.
04 Accounts
Where account registration is required, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at info@hombcloud.com if you suspect any unauthorised access.
We reserve the right to suspend or terminate accounts that are found to be in breach of these Terms.
05 Payments
All fees are stated in the currency specified at checkout. Full payment is required before service activation or order fulfilment unless otherwise agreed in writing.
We accept payment via the methods displayed on the Platform at the time of purchase. We do not store card details — payment processing is handled by authorised third-party providers.
All prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes, duties, or levies applicable in your jurisdiction.
06 Cancellations & refunds
Cancellation and refund eligibility varies by Service and is set out in the relevant Part below. In general:
- Digital services, including compute access, may be non-refundable once activated.
- Hardware orders are governed by the Marketplace terms and the applicable Supplier or Seller policy.
- All cancellation requests must be submitted in writing to our support team at info@hombcloud.com.
07 Acceptable use
You agree not to use our Services to:
- Engage in any unlawful, fraudulent, or deceptive activity;
- Attempt to interfere with, disrupt, or gain unauthorised access to our platform or infrastructure;
- Circumvent security measures or access controls;
- Violate any applicable law, regulation, or third-party right.
Homb Cloud reserves the right to suspend Services immediately and without notice if there is a reasonable suspicion of misuse.
08 Intellectual property
All content, trademarks, platform features, and technology associated with Homb Cloud remain the exclusive property of HOMB CLOUD FZ-LLC. Nothing in these Terms grants you a licence to use our intellectual property beyond what is strictly necessary to use the Service purchased.
09 Privacy & data
Our collection and use of personal data is governed by our Privacy Policy, available on our website. By using our Services, you consent to data processing as described therein.
10 Limitation of liability
To the maximum extent permitted by applicable law, HOMB CLOUD FZ-LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of our Services, including but not limited to loss of data, revenue, or business opportunity.
Our total aggregate liability to you for any claim shall not exceed the total amount paid by you for the specific Service giving rise to the claim in the three (3) months preceding the event.
11 Indemnification
You agree to indemnify, defend, and hold harmless HOMB CLOUD FZ-LLC, its directors, employees, and agents from and against any claims, liabilities, damages, penalties, and costs (including reasonable legal fees) arising from: (a) your use of the Services; (b) your breach of these Terms; or (c) your violation of any applicable law or third-party right.
12 Governing law & dispute resolution
These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from or in connection with these Terms shall first be referred to mediation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of the UAE.
13 Amendments
Homb Cloud reserves the right to update or amend these Terms at any time. Material changes will be communicated via email or platform notification at least 14 days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
14 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Part A
Cloud Mining Services
Terms specific to the purchase of cloud mining hashrate capacity through the Homb Cloud platform.
A1 Service description
Homb Cloud provides clients with access to remote computing infrastructure that participates in Bitcoin network validation ("Cloud Mining Service"). Under this Service, clients purchase a defined allocation of hashrate capacity for a specified contract duration.
The Service grants you the right to use allocated computational capacity. It does not grant ownership of any physical hardware, facility, or infrastructure.
A2 Service activation
Upon receipt of a valid Order Confirmation and cleared payment, your hashrate allocation will be activated within the timeframe specified in your order. Activation timelines may vary subject to infrastructure capacity and network conditions.
You will receive confirmation of activation via the email address associated with your account.
A3 Contract duration & renewal
Cloud Mining contracts are offered for fixed terms as specified at the time of purchase. Contracts do not automatically renew unless this option is explicitly selected and confirmed by the Client at checkout.
Upon expiry, hashrate allocations will be deactivated. Clients wishing to continue must place a new order.
A4 Fees & payment
Service fees are payable in full at the time of purchase and cover the contract duration specified in your order. Fees may include a maintenance component covering infrastructure operating costs; this will be clearly stated at checkout where applicable.
Homb Cloud reserves the right to adjust fee structures for new orders. Existing active contracts are not affected by fee changes unless expressly stated.
A5 Maintenance & downtime
We carry out planned maintenance from time to time to ensure the reliability and performance of our infrastructure. Where possible, we will provide advance notice of scheduled maintenance windows.
Unplanned downtime may occur due to hardware failure, network disruption, or other unforeseen events. Short-duration interruptions are a normal part of mining infrastructure operations and do not constitute a breach of these Terms.
We will make reasonable efforts to restore service promptly in the event of unplanned downtime.
A6 Network conditions
Bitcoin network difficulty, hashrate distribution, and block reward structures are determined by the Bitcoin protocol and are outside of Homb Cloud's control. These factors directly influence the output associated with any hashrate allocation and may vary materially over the life of a contract.
Homb Cloud makes no representations regarding expected output levels. Historic network performance is not indicative of future results.
A7 Bitcoin output & disbursement
Any Bitcoin associated with your hashrate participation will be reflected in your platform dashboard. Disbursement to an external wallet requires a minimum threshold balance and may be subject to applicable network transaction fees.
Homb Cloud processes disbursements on a schedule communicated on the platform. We are not responsible for delays caused by blockchain congestion or third-party wallet issues.
A8 Service suspension
We reserve the right to suspend your Cloud Mining Service without prior notice in the event of:
- Non-payment or payment failure;
- Breach of these Terms or the General Terms;
- Force majeure events (see A10);
- Regulatory or legal requirements necessitating service interruption.
Suspension does not automatically entitle the Client to a refund of fees already paid.
A9 Cancellation & refund policy
Cloud Mining contracts may be cancelled by the Client at any time; however:
- Service fees paid in advance are non-refundable once the service has been activated.
- Cancellation requests submitted before activation may be eligible for a full refund, subject to review.
- Where a contract is terminated early by Homb Cloud for reasons not attributable to the Client, a pro-rata refund of the remaining contract period will be offered.
All cancellation requests must be submitted in writing to info@hombcloud.com.
A10 Force majeure
Homb Cloud shall not be held liable for any failure or delay in performing its obligations where such failure results from circumstances beyond our reasonable control, including but not limited to: acts of God, regulatory action, severe network disruption, civil unrest, or infrastructure failure by third-party providers.
A11 Disclaimer
The Cloud Mining Service is provided on an "as is" and "as available" basis. We make no representations or warranties, express or implied, regarding the performance, availability, or output of the Service beyond what is expressly stated in these Terms.
Part B
Mining Hosting Services
Terms specific to the co-location and hosting of client-owned mining equipment at Homb Cloud facilities.
B1 Service description
Homb Cloud provides co-location services for client-owned mining hardware ("Equipment") at our operating facilities ("Hosting Service"). This includes physical rack space, power supply, network connectivity, and basic operational monitoring as specified in the applicable hosting plan.
The Client retains full ownership of their Equipment at all times. Homb Cloud does not take ownership of, or acquire any interest in, the Equipment or the digital assets it generates.
B2 Equipment acceptance
Prior to hosting, Equipment must be submitted for assessment. Homb Cloud reserves the right to decline Equipment that:
- Does not meet minimum operational specifications;
- Is damaged, modified, or presents a safety risk;
- Is subject to outstanding legal claims or ownership disputes.
Accepted Equipment will be recorded in the Order Confirmation, including make, model, serial number, and condition at intake.
B3 Hosting fees
Hosting fees cover the cost of rack space, power, and connectivity for the period specified in your hosting plan. Fees are payable in advance on the schedule set out in your Order Confirmation.
Homb Cloud reserves the right to suspend hosting services if fees are not paid within the stated grace period following a payment due date. Equipment will remain at the facility during any suspension period, and storage charges may apply.
B4 Client responsibilities
The Client is responsible for:
- Ensuring Equipment is delivered in full working order and within the specifications agreed;
- Maintaining valid software licences and mining pool configurations;
- Configuring and managing their own mining pool account and wallet addresses;
- Promptly notifying Homb Cloud of any known Equipment faults;
- Ensuring Equipment complies with all applicable laws and regulations in the Client's jurisdiction.
B5 Our responsibilities
Homb Cloud will:
- Provide a secure, climate-controlled environment for hosted Equipment;
- Maintain facility power and network connectivity within the uptime targets specified in the hosting plan;
- Perform basic operational monitoring and notify the Client of any detected issues;
- Handle Equipment with reasonable care during intake, operation, and return.
B6 Power & connectivity
We target the power and connectivity uptime levels specified in your hosting plan. Planned maintenance windows, force majeure events, and third-party infrastructure failures are excluded from uptime calculations.
Power consumption above the allocated capacity in your plan may incur additional charges as set out in your Order Confirmation.
B7 Facility access
Clients may not access the facility unannounced. Any site visits require:
- Advance notice of at least 48 hours, or such other notice period as specified in your plan;
- Identity verification;
- Escort by an authorised Homb Cloud representative.
Remote monitoring access may be provided subject to facility capability and the applicable hosting plan.
B8 Liability for equipment
Homb Cloud takes reasonable precautions to protect hosted Equipment. However, we shall not be liable for loss, damage, or destruction of Equipment arising from:
- Equipment failure or defects present prior to or upon delivery;
- Acts of God, fire, flood, or other force majeure events;
- Theft or vandalism, provided appropriate facility security has been maintained;
- The Client's failure to maintain Equipment in accordance with manufacturer specifications;
- Equipment being powered down or removed at the Client's instruction.
B9 Termination & equipment return
Either party may terminate the Hosting Service with 30 days' written notice, unless a minimum contract period applies as specified in the Order Confirmation.
Upon termination:
- All outstanding hosting fees become immediately due and payable;
- The Client must arrange collection of Equipment within 14 days of termination;
- Equipment not collected within this period may be subject to storage charges;
- If Equipment remains uncollected for 60 days following termination, Homb Cloud reserves the right to dispose of it, with proceeds applied to any outstanding balance.
B10 Mining output
Mining pool credentials and output wallet addresses are configured by the Client and remain under the Client's sole control. Homb Cloud does not receive, hold, process, or control any Bitcoin or other digital assets generated by hosted Equipment.
Part C
Miner Marketplace
Terms specific to the purchase and sale of mining hardware through the Homb Cloud Marketplace.
C1 Platform role
The Homb Cloud Miner Marketplace ("Marketplace") is a platform that connects buyers with hardware suppliers and sellers. Homb Cloud acts solely as an intermediary facilitating the transaction and does not manufacture, own, or warrant any hardware listed.
The contract of sale for any hardware is formed directly between the buyer and the relevant Supplier or Seller. Homb Cloud is not a party to that contract.
C2 Listings
Hardware listings on the Marketplace are provided by Suppliers (for new equipment) and Sellers (for second-hand equipment). Homb Cloud does not independently verify the accuracy of all listing information and makes no guarantee as to the completeness or currency of details provided.
Buyers are encouraged to review all available specification information and contact the Supplier or Seller with any questions before placing an order.
C3 Purchasing hardware
New hardware (Supplier listings): Hardware is sourced from authorised manufacturers and distributors. Specifications, availability, and lead times are subject to Supplier confirmation. New hardware is covered by the applicable manufacturer warranty, details of which will be provided in the Order Confirmation.
Second-hand hardware (Seller listings): Second-hand hardware is listed and described by the Seller. Condition ratings and descriptions are the Seller's own representation. Homb Cloud does not independently inspect or certify second-hand hardware. Buyers purchase second-hand equipment having satisfied themselves as to its condition, and should raise any concerns directly with the Seller before completing a purchase.
C4 Payments & marketplace fees
Payment for hardware is processed through the Platform. Homb Cloud may retain a platform facilitation fee from transactions; this is included in the listed price and is not charged separately to the buyer.
All payments are subject to the General Terms payment conditions (Section 5).
C5 Shipping & delivery
Shipping timelines, costs, and logistics are managed by the Supplier or Seller and will be communicated in the Order Confirmation. Homb Cloud is not responsible for delays, damage in transit, or losses caused by third-party logistics providers.
Risk of loss and title to hardware passes to the buyer upon delivery unless otherwise stated in the Order Confirmation.
C6 Returns & disputes
Return eligibility and dispute resolution for hardware purchases are governed by the Supplier's or Seller's own return policy, which will be referenced in the Order Confirmation.
Where a dispute arises between a buyer and a Supplier or Seller, Homb Cloud may assist in facilitating communication but is not obligated to adjudicate, arbitrate, or assume financial liability for the outcome.

C7 Seller standards
All Sellers on the Marketplace agree to our Seller Standards, which require accurate listing descriptions, fair dealing, and prompt fulfilment. Homb Cloud reserves the right to remove listings or suspend Sellers who fail to meet these standards.
C8 Disclaimer
The Marketplace is provided as a platform service only. Homb Cloud makes no warranty, express or implied, as to the merchantability, fitness for purpose, or performance of any hardware listed. Buyers rely on Supplier and Seller representations and their own due diligence when making a purchase.
